1Acceptance of These Terms

These Terms & Conditions ("Terms") form a legally binding agreement between you (the user, customer or student) and Target CMS ("Target CMS", "we", "our", "us"), the operator of targetcms.in ("the Website").

By accessing the Website, creating an account, attempting any test, joining any class, or purchasing any book, test series, course or service, you confirm that:

• You have read, understood and agree to be bound by these Terms;
• You also agree to our Privacy Policy, Shipping & Delivery Policy and Cancellation & Refund Policy, which are incorporated into these Terms by reference;
• You are at least 18 years of age and legally capable of entering into a contract under the Indian Contract Act, 1872.

If you do not agree with any part of these Terms, please do not use the Website. Continued use after any update to these Terms constitutes acceptance of the updated Terms.

2Who We Are & What We Provide

Target CMS is India's dedicated preparation platform for the UPSC Combined Medical Services (CMS) examination, created by Dr. Varun Agarwal and Dr. Ritu Agarwal. Our offerings ("Services") include:

• 📚 Printed books — Rapid Revision, Solved Papers 2020–25, Subject & Topic-wise PYQ Question Bank, the CMS Interview Guide, and money-saving combos such as the Capsule Combo;
• 📝 The CMS Test Series (Full Engine) — full-length mock tests (including the Grand Test finale), subject-wise tests, detailed solutions, performance analysis, All-India Rank, Expected AIR and selection-probability analytics;
• ⚡ Ultra Rapid Revision — the one-day live full-syllabus revision course streamed inside your dashboard, with recordings and annotated notes PDF;
• 🎯 Mentorship & interview preparation programs;
• 🆓 Free tools — PYQ Practice (2020–2025 papers), Topic-wise MCQs, RR Videos, the UPSC CMS Rank Predictor, and blog articles on strategy, salary and interviews.

We may add, modify, reschedule, suspend or discontinue any Service, feature, test, class or content at any time. Where a change materially affects a paid product you hold, we will notify enrolled students (see Section 9).

3Your Account & Eligibility 👤

• Accuracy — you agree to provide true, accurate and complete information when registering or ordering, and to keep it updated;
• Security — you are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at support@targetcms.in if you suspect unauthorised access;
• One person, one account — accounts and dashboard access are strictly personal and non-transferable. Sharing your login with friends, batchmates, Telegram groups or anyone else is a material breach of these Terms;
• Enforcement — we monitor for suspicious usage patterns (e.g., simultaneous logins from multiple devices/locations). Confirmed account sharing may result in suspension or termination without refund;
• Age — you must be 18 or older to purchase from the Website.

4Purchases, Pricing & Payments 💳

• All prices are in Indian Rupees (₹) and inclusive of applicable taxes unless stated otherwise. Shipping charges, if any, are shown at checkout before payment;
• Payments are processed securely by our payment gateway partner, Cashfree (UPI, cards, net banking, wallets). Your order is confirmed only upon successful payment;
• Prices, discounts and offers (e.g., launch discounts, combo savings like the ₹1,798 Test Series + Rapid Revision combo) may change at any time without notice. The price applicable to you is the one displayed at the time of your order. No refunds or adjustments are made for later price drops or new offers;
• Product inclusions are exactly as described on the product page and pricing table at the time of purchase — for example, the Ultra Rapid Revision course is a separate add-on and is not included in the Test Series unless purchased as the combo;
• Pricing errors — in case of an obvious pricing or listing error, we reserve the right to cancel the order and issue a full refund;
• Digital access validity — Test Series, courses and recordings are valid for the current exam cycle (e.g., CMS 2026) unless a different validity is stated on the product page;
• Cancellations, replacements and refunds are governed exclusively by our Cancellation & Refund Policy.

5Intellectual Property & Content Licence 📚 Personal Use Only

All content on the Website and in our products — including books, notes, mnemonics, one-liners, flowcharts, question banks, test questions, explanations, videos, live-class streams, recordings, PDFs, analytics, the Rank Predictor, software, logos, design and branding — is the intellectual property of Target CMS and/or its authors (including Dr. Varun Agarwal and Dr. Ritu Agarwal), protected under the Copyright Act, 1957 and other applicable Indian and international laws.

What your purchase gives you

• A limited, personal, non-exclusive, non-transferable, revocable licence to access and use the purchased content for your own exam preparation only;
• Ownership of the physical copy of any printed book you buy — but not of the content inside it, which remains copyrighted.

What you must NOT do

• Copy, screen-record, download (except where a download button is explicitly provided, e.g., notes PDFs for personal use), mass-screenshot or otherwise reproduce any course, video, live stream, test or PDF;
• Share, forward, upload, sell or distribute our content on Telegram, WhatsApp, Google Drive, YouTube or any other platform or medium;
• Photocopy, scan, or digitally circulate our printed books, in whole or in part;
• Share your account or dashboard access with anyone (see Section 3);
• Use our questions, explanations, notes or structure to create competing books, test series, coaching material or apps;
• Remove or alter any copyright notices, watermarks or attribution.

6Educational Disclaimers 🏛️

• Independence — Target CMS is an independent educational platform. We are not affiliated with, endorsed by, or connected to the Union Public Service Commission (UPSC) or any government body. "UPSC" and "CMS" are used solely to describe the examination our materials prepare you for;
• No guarantee of results — our content is prepared with great care by experienced educators and toppers, but we do not and cannot guarantee selection, rank, marks, cut-off clearance or success in any examination. Outcomes depend on many factors, above all your own preparation;
• Rank Predictor & analytics — the Rank Predictor, Expected AIR and selection-probability figures are statistical estimates based on historical data, cut-off trends and user inputs. They are for guidance and motivation only, and do not represent official UPSC results or promises;
• Exam information — exam dates (e.g., CMS 2026 on 2 August 2026), patterns, syllabus notes and rules referenced on the Website are based on publicly available information and may change. Always verify with official UPSC notifications at upsc.gov.in;
• Content accuracy — medical facts, guidelines and answer keys evolve. We update content regularly and correct verified errors, but we do not warrant that every item is error-free at all times. Found a mistake? Tell us — we fix genuine errors quickly;
• Not clinical advice — all medical content is provided strictly for examination preparation. It is not medical advice and must not be used for diagnosing or treating patients;
• Testimonials — student testimonials and topper results reflect individual experiences and do not guarantee similar outcomes for you.

7Fair Use of Tests, Ranks & Prizes 🏆

Our Test Series runs on trust — All-India Ranks and prizes (e.g., Top-3 prizes across the series) only mean something if everyone plays fair. By attempting any test, you agree to:

• Attempt tests individually, without collaboration, group-solving or external assistance during a timed attempt;
• Not use bots, scripts, automation, multiple accounts or any technical means to attempt tests, extract questions or manipulate scores;
• Not share live test questions with other candidates while a test window is open.

• Malpractice, manipulation or multi-account abuse may lead to score cancellation, disqualification from ranks and prizes, and account termination without refund — at our sole discretion.

Prizes, where announced, are subject to the specific conditions published with them (eligibility, verification of identity, and fair-attempt review). Our decision on rank and prize disputes is final.

8Acceptable Use of the Website 🖥️

You agree not to:

• Use the Website for any unlawful purpose, or in violation of these Terms or any applicable law;
• Attempt to hack, probe, scrape, crawl, decompile, reverse-engineer or disrupt the Website, test engine, servers or security features;
• Introduce viruses, malware or any harmful code;
• Post or transmit abusive, defamatory, obscene, hateful or misleading content in any comment, review or interactive feature;
• Impersonate any person, misrepresent your affiliation, or use another user's account;
• Place fraudulent orders or initiate false chargebacks/payment disputes for products you have received and used — such conduct may lead to account termination and recovery action.

9Live Classes, Test Calendar & Scheduled Events 📅

• Dates and times for live classes (e.g., Ultra Rapid Revision) and tests (e.g., mocks and subject-wise tests in the Test Calendar) are announced in advance, but may shift slightly for operational reasons — enrolled students are notified of any change;
• Live classes stream inside your dashboard on targetcms.in for members only; classes may be conducted in Hinglish as described on the product page;
• Where recordings are promised, they are added to your dashboard after the live session, along with any promised notes (e.g., the annotated notes PDF), for the stated access period;
• Missing a live session does not entitle you to a refund — recordings ensure you never lose the content (see our Refund Policy);
• We are not liable for interruptions caused by your internet connection, device or power supply. For interruptions on our side during a live event, we will provide the recording and, where reasonable, reschedule or extend access.

10Website Availability & Technical Issues 🔧

• We aim to keep the Website and test engine available 24×7, but do not guarantee uninterrupted, error-free operation. Maintenance, upgrades or events beyond our control may cause temporary downtime;
• If a technical fault on our side disrupts a scheduled test, we may extend the test window, reschedule, or take other reasonable corrective steps;
• You are responsible for your own device, browser compatibility and internet connectivity.

11Third-Party Links & Services 🔗

The Website contains links to third-party platforms — our YouTube channel, Instagram, Telegram community, WhatsApp channel, embedded YouTube videos, and marketplaces such as Amazon and Flipkart where our books are also sold. These are provided for convenience only:

• We do not control and are not responsible for the content, policies, pricing or practices of third-party sites;
• Purchases made on third-party marketplaces are governed by those platforms' own policies (returns, delivery, pricing) — not by ours. Our best-price guarantee applies to purchases made on targetcms.in;
• Accessing third-party platforms is at your own discretion and risk.

12Limitation of Liability ⚖️

The Website, its content and Services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, except as required by law.

To the maximum extent permitted by applicable law, Target CMS, its founders, authors, employees and partners shall not be liable for any indirect, incidental, special, punitive or consequential damages — including loss of marks, rank, selection, opportunity, income, data or goodwill — arising from your use of, or inability to use, the Website, content or Services.

In any event, our total aggregate liability for any claim arising out of these Terms or your use of the Services shall not exceed the amount you actually paid to us for the specific product or service giving rise to the claim.

Nothing in these Terms limits rights that cannot be limited under Indian law, including your statutory rights under the Consumer Protection Act, 2019.

13Indemnity

You agree to indemnify and hold harmless Target CMS, its founders, authors and team from any claims, damages, losses, liabilities and expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law or third-party right, or your misuse of the Website or content — including, without limitation, any act of content piracy or account sharing.

14Suspension & Termination 🚫

• We may suspend or terminate your account and access to Services, without refund, if you materially breach these Terms — in particular for content piracy, account sharing, test malpractice, payment fraud, chargeback abuse or attacks on the platform;
• Where practical for minor first-time issues, we may issue a warning before termination — but we are not obliged to;
• You may stop using the Website at any time and may request account deletion as described in our Privacy Policy;
• Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnity, governing law) survive it.

15Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control — including natural disasters, epidemics, floods, strikes, riots, war, power or internet outages, courier network disruptions, government orders or changes to the examination itself. Obligations are suspended for the duration of such events, and we will resume performance as soon as reasonably possible.

16Governing Law, Jurisdiction & Disputes 🇮🇳

• These Terms are governed by and construed in accordance with the laws of India;
• Any dispute arising out of or relating to these Terms, the Website or the Services shall be subject to the exclusive jurisdiction of the competent courts in India;
• Before initiating any formal proceeding, we encourage you to first write to support@targetcms.in — the overwhelming majority of issues are resolved amicably within days.

17General Provisions

• Entire agreement — these Terms, together with the policies incorporated by reference and the specific terms on any product page, constitute the entire agreement between you and Target CMS regarding the Services;
• Severability — if any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force;
• No waiver — our failure to enforce any right or provision is not a waiver of that right;
• Assignment — you may not assign your rights under these Terms; we may assign ours in connection with a business transfer, with continuity of your purchased access;
• Notices — we may notify you via email (to your registered address), your dashboard, or notices on the Website;
• Updates to Terms — we may revise these Terms from time to time. The updated version will be posted here with a new "Last updated" date; material changes may additionally be notified by email or website notice. Continued use after an update constitutes acceptance.
